Well if he isn't willing to use good assets in trade (said today he isn't dealing their first rounder or top prospects) he's pretty limited in trying to win in this window they are in. Brining in someone like Kane is kind of all he can do.

What a disaster is correct, and the biggest mention is the distraction that they still haven't figured out they need to improve Goaltending  This might turn into a comedy once again for the Soilers lol.

Can't wait to see the self destruct detonate once again.  Holland / Chiarelli  ?  Same chemistry... lol. Welcome to the "Ole boys club once again"

How does Tim Peel become an insider?  Especially when it comes to a player whose contract was terminated.

 

What I am less clear about is what the deal is with the player's immediate future.

The NHLPA filed a grievance.

One would think that he can't sign or play with a team while this is still in play.

If he wins the appear, then he is a Shark in the AHL.

 

But what do I know.

As much as the NHL despises Kane for his antics, they won't just let it drop.

If anything, holding him until the grienance is decided is what they would do.

I was under the impression that the bank owns his contract because he declared bankruptcy.  He owes the banks over $30-million or so.  He wouldn't have seen any of that money anyways?

 

...but if he signs a brand new contract, then different story?  Could this have been a big act to give the banks the finger and then sign a new deal?

I want to say he's out of luck and that won't work.   

 

But I don't actually know what happens when he gets a contract in a different country.

Sounds like when Kane signs it's going to be for something small, like 1 million. No one seems to be suggesting he's going to get anything more than that. 

Oilers have sufficient LTIR space to sign that type of deal as it does not sound like Klefbom will play at all this year.

Be more interested to see how the PA treats this. Kane had over 15 mill left on his contract and I can't imagine he's every going to get anywhere close to that ever again. How can the PA and Kane's reps be ok that the Sharks just get to walk away from all of that? I imagine the NHL is more ok with it, but it also sets a big of a dangers precedent they will want to make sure they have some control over.

Why haven't other teams spoken out about this?  Just like the Kings and Mike Richards, the Sharks should face some kind of cap penalty, even $1-mil for next 4-years.  How can everyone be okay the Sharks can just terminate the contract instead of buying him out?

Yeah, I was wondering about that myself.

They looked for and found a way to get out from under it.

I don't think h could even sign with another team while a grievance is in place.

What I also don't know is whether the arbitor can invalidate SJ's termination.

If they were able to do that, he is a Sharks player.

My guess is they have just not publicly and that is why today you are hearing that now the NHL is investigating. I will be shocked if the Sharks get to walk away from this but I also have never seen an NHL contract so i'm not sure what type of language is in there about breach. 

 

With Richards it was about 3 months before they reached a settlement after the PA filled a grievance over the termination, which I believe they ether have or plan to do with Kane.

I am totally speculating but maybe the wording of the contract is such that it is only owed to the individual, and cannot be legally extended to a bank.   And this might be something Kane has to agree to.

 

In otherwords, terminating a player where the player agrees not to be bought out.   Since it would go to a third party not part of the contract.

 

You can garnish wages in bankruptcy but I am not sure if garnishing future contracts is as clear.    

 

Now switch up countries, and they may just have a loophole.

If they end up having to keep him. They could just trade them to the Oilers and retain half of the contract. Maybe they get another team involved and have them retain. Maybe they don't care if there is any compensation coming back? They just want out? I guess half a contract is still a tough loss for the team.

The only viable option was for EDM to sign him to a cheap deal.  They only have LTIR space, not real cap space.  A deal less than $1m makes sense.  If they need to trade and have a team retain, they would need to give up a 1st plaus the reade value.  They are not going there.
